i bought a iphone 5s from my cousin bring it home hook it up to i tunes and reset it then during set up it asks for his apple id and password so i caled him and he dont remember it so now i am stuck with a phone that dont work does any body know how i can get passed the activation lock

It's a theft deterrent feature and can only be unlocked by the rightful owner's Apple ID & password, not Apple or anyone.
Tell him to use Apple's iForgot service or contact their Account Security team, or if he's the iPhone’s original owner, supply Apple with its purchase receipt and ask them to remove the lock.
