Hi my right earplug on my earphones have stopped working properly and the volume is very dim on that side and Normal on the left hand side. I did not buy these from an Apple store but they are actual beats earplugs. Am I still able to contact Apple about this or are they broken.

It seems like that they need to be cleaned:

Also try adjusting the balance: Go to Settings > General > Accessibility and scroll down to “L vs R” (Adjust the audio volume balance) and make changes.
