How Find my iPhone works

If find my iPhone is turned off on a device that has been sold to me but the phone still has a passcode, can I format the device using iTunes and dfu mode and hence make use of the phone? Without there being an activation lock?

Find my iPhone has nothing to do with the device's IMEI. It is a feature of Apple's iCloud service tied to an AppleID. There is no site where you can check if activation lock is enabled on a device. Apple had such a site at one time, but took it down quite awhile ago now due to possible abuses and hacks.
