2) I have insurance and is in need of a new one, what steps are needed to do so?

See the steps here to regain use of the phone, If you forgot the passcode for your iPhone, iPad, or iPod touch, or your device is disabled - Apple Support


It is not necessary to replace it unless you are unable to restore it.
