I find that after using markup on a few photos it stops working. Anyone know what may be going on? The function reappears if I don't use the photo app for a while, only to stop functioning after a few uses.

I am going to suggest you look for another, better third party app that is capable of markng up/writing on photo/images using the Apple Pencil.
Some Apple app features simply do not work all that well.
With most Apple iOS apps, Apple, typically, always gets an app like 75% “there” or working, but never goes the full distance to get a completely trouble-free app.
Do a search in the iOS App Store using the search terms
