If you had recently purchase a new iPhone and yet not set up and signed in with Apple ID and password https://support.apple.com/en-us/HT202033

You have to sign in with same Apple ID and password used in old apple iPhone , so some photos and other data must be there on the iCloud server then turn on iCloud photos box in an iPhone see the details in this article https://support.apple.com/en-in/HT204264

The old photos will start syncing if you had also turned the photos box in an old iPhone and the iCloud storage data in that old iPhone was also in designated limits .
