I talked about the "return policy" not about the warranty.
During the return policy period, you can return it, or ask for a refund, and if you bought it at an Apple Authorized Reseller, that device will be immediately replaced, if available.
As far as contacting the seller, you need to do it. You're not addressing Apple here. This is a public user to user tech support forum, and we're just users like you.

If you bought it at an Apple Store or authorized reseller, you have 14 day to return it.
If you bought it at a 3rd party shop, ask them about their return policy.
