Turn off find my iphone

In this instance you would need to remove your device from Find My on icloud.com.

I just got off chat to answer this. They had me erase, in my case iPad and then it'll let u remove from list and turn off Find my iPhone. I couldn't go further in my claim then after doing that it worked. Best of Luck!
