Reply to Lindasong, I had the same problem with a new iPod out of the box. If you go to Control Center in Settings and enable "Silent Mode" in your control center, you can then toggle the Silent Mode button on and off. Control Center is what you have when you swipe up from your Home Screen from the bottom.
