Air Pods Pro bought had a serial number that has been replaced.

What are my options here with apple if my airpods that I bought off someone has a replaced serial number and there’s no way to get my money back since the seller cut communication. Can I give that airpod back to apple since essentially it’s not supposed to exist? Help?
