what about if the previous owner doesnt remember their icloud password, so you cant login and setup the phone; is there a way to set it up without it?

No. That owner needs to recover their AppleID so they can disable activation lock on that device for you. If they cannot or will not do that, then you will never be able to use that device yourself.
