Because the developer likely hasn't ported the app/games to iOS.

I seriously doubt that is what Apple has said.

If he has submitted an app for consideration for distribution in the app store and been denied, then his app is not currently up to the tight standards Apple requires. He current app violates the requirements and until he has complied, the app will not be allowed.

Period.

It is up to the developer to create an app that is up to Apple's standards. The ball is in his court.
