I just wanted to update from my previous comment... I called the apple support line, was able to get an appointment at the Genius Bar within 2 days and went to see them before the warranty was up. The staff member who helped me was super helpful, kind, and he took the old pair and sent me a brand new pair within 5 days, without any trouble or having to push or fight for it. So far my experiences with apple support has been nothing but positive, although I'm not denying that this may be a weakness in the Beats product and I know this pair might also crack in the same way over time. (Also I got these headphones with the back to school bundle with my macbook pro so I didn't shell out $400 for them, so I probably wasn't as frustrated with the crack as I would have been had I bought them outright.)
