My photo library doesn't sync well, so I wanted to turn this cloud sync off and on again. But I found out that somehow I miss this Photos item in the iCloud settings ... (which will probably cause the synchronization problem). Is it possible to fix it anyhow before I do the factory settings?
See picture, I don't have this green labeled item...

If the photos are safely stored in iCloud (confirm at iCloud.com), then consider reseting/restoring the device.

To have back possibility turn on or off iCloud photo synchronization. I don’t have this option at the moment.
Per your screenshot you posted, it's already turned on.
first image showed how it should look like.
now I share my situation where no photos option available...
so I performed a complete system recovery in case of iOS failure through the Finder. Photos option did not appear in icloud 🙁 any other hint? It works well on iPad.
As I wrote in my last comment - I did reset / restore my device with no luck. Still missing Photos menu

Yes, I can confirm it. 30% of all photos are stored localy in the Photos app. That is why I wanted to do resynchronization between iPhone and iCloud.
