How do I make sure that my iphone can't be used and that they can't get into my icloud if the thief turned off find my iphone?

If the thief turned off Find My iPhone on your iPhone that would mean that they know your Apple ID/iCloud password. See the following for information about changing your password and also other information: If you think your Apple ID has been compromised - Apple Support
