if i bought an older iphone 4S and the previous owner says that he cant remember the email the is associated with the phone due to the fact his 13 year old son was using the phone.
my question is. can i use the phone for its actual use or is it a $40 paperweight

You need to contact the previous owner to have them log out of iCloud or go to https://www.icloud.com/find/ and erase the device, then remove it from their account. If you can’t do that, the device is useless. Apple won't unlock it.
