Unable to activate, but don't have access to previous owner's apple id - help?

I have an iPod that I am trying to get loaded for a Christmas gift, but it won't let me activate the iPod. It's saying it's unable to activate and when I plug the iPod into my computer, iTunes is saying that I need the previous owner's Apple ID, but I do not have that nor do I have access to the previous owner. Please help!

You will not be able to use this iPod with the original ID and Password. Activation Lock is an anti-theft feature that cannot be bypassed. See: Activation Lock for iPhone, iPad, and iPod touch - Apple Support
