Apple gave me s refurbished iphone 12 pro max . Wen i paid for a brand new phone

Im really really upset i bought an iphone 12 pro max cash out of the applestore and i notice how it started malfunctioning so i took it back to apple n they recommended the genius bar people . They gave me a unsealed phone out of a white box not a brand new iphone as i paid for . I will continue to escalate this matter because i paid for a BRAND NEW PHONE NOT A SERVICE REFURBISHED UNIT .

Did this occur after the 14 day return/exchange period? If so....then it was replaced under warranty which means yes, it’s possible you could receive a refurbished one. Although just because it came from the replacement supply doesn’t mean it’s refurbished. All replacements under warranty come in a white box not a retail box. Good luck with the argument though but understand that per the warranty it clearly states that replacement parts/device may be refurbished or “like new”. Only time you have a true case is if this was done during the return/exchange period where you could still receive a full refund or a new exchange

Ok...if you read the warranty which is pretty much the same for all phones you would see the info we have explained to you. Outside of the return period you are under the warranty terms and conditions. I get the frustration but you’re not being wronged. If the replacement still has an issue then you contact Apple again and it would be replaced again. Now, you may be opting to go through all of this for an issue that may or may not be hardware related (no clue what your original issue was that prompted the replacement ). It’s possible whatever is going on may very well be a software issue that won’t be addressed until an iOS update fixes it. At any rate...yes, you paid for a brand new device. After 14 days it is no longer brand new and is not eligible for refund or a new in-box retail replacement. It is eligible for warranty repair or warranty replacement. Either way....good luck with your pursuit. It’s not likely to go the way you are demanding unfortunately as everything is being done per the terms and agreement that you accepted when you purchased and activated your phone....even though most people accept the terms without bothering to read them

  1. Past the 14 day return window means you get service under warranty. The warranty explicitly says new or like new.
  2. If the replacement has the same issue it sounds like it’s not a hardware issue and even a new phone won’t help. It makes it sound like a software issue carried over from backups and/or transfers unless you can give us more detail.
  3. No matter how much you threaten, ***** ir wine the fact remains Apple assisted you under the warranty terms.

Like I said...good luck with that. You would need to keep contacting Apple and do whatever it is you are planning on doing. This is a user to user forum so you’re communicating with fellow customers, it Apple. The info you are being provided is solely to try and help you understand what the facts are in regards to the terms and agreement. You might not like it and that’s fine. You can fight it as much as you like. If you manage to demand your way into something that is outside of the agreement that’s great. If you don’t get your way it sucks but you’ll have to decide how you want to handle it. Worst case scenario is you opt to sell it yourself and buy something that’s not Apple. Just don’t be surprised if you find yourself in the same predicament with another brand if you have an issue and it’s handled under warranty terms.

yes it was a little pass the 14 days . Also the phone they gave me is having more problems then the original BRAND NEW PHONE . The genius bar manager at the lenox square mall in atlanta GA got mad at me and denied me service wen i ask em for a brand new BECAUSE THIS IS A REFURBISHED PHONE AND IS HAVING PROBLEMS AN HR LATER AFTER INMEFT THE STORE . He didnt even help look at the device . I paid for a brand new phone not s refurbished one

Your baseless assumption is completely wrong. They last just as long. I purchase my Apple devices from Apple’s certified refurbished stock only, same warranty, same services, same product, same guarantees and they’ve lasted just as long as brand new ones. Same when we’ve had an iPhone 5s replaced under warranty because my husband dropped it in his glass of water and didn’t realize it for 30+ minutes, it lasted for years as expected of Apple devices.
