Brand new Apple iPhone 12 Pro Max Overheating and Battery failure

Pulled the Brand New iPhone out of box and spent 4 hours trying to get the thing to cool down to set up. After a day overheating and shutting down I called Apple, with the guy on the other end telling me I have corrupt backup data. I am overseas trying to get it figured out and Apple blames me for their defective device. Anyone else having overheating issues or issues with the new iPhone 12?
