Hi. If I buy a brand new sealed Apple TV 4K but second hand with no proof of purchase, I would like to know if the warranty starts on the day of purchase or day of activation ... the seller is telling me that I shouldn’t worry and warranty starts when I start the machine for the first time but just wanted to be sure.

The warranty starts when the original buyer purchased it from Apple or an Apple Authorized Reseller.
If its history is as shady as your summary seems to imply, then it may not qualify for warranty at all.
