Apple lost my phone during a repair and they refuse to take responsibility for it. What do I do?

Did Apple lose it or did the shipper (FedEx, UPS, etc) lose it? If it was last in their possession that shouldn't be hard to prove. I assume you can't do an AppleCare+ claim because you don’t have your Find My iPhone feature turned on since you’re supposed to remove everything when sending it in for service. If you shipped it and it was lost in transit either on the way to Apple or on the way back to you it may be on the shipper to rectify. Definitely reach out to Apple again and get clarification
