After performing a fresh install of Catalina I noticed a problem where the screen saver activates when I have it set to not activate when the power is attached.
can anyone tell me why it activates after about an hour or so without touching the Macbook pro.

That's incorrect. The setting in your screen shot is to prevent the display from turning off. That's separate from the screen saver.
Did you disable the screen saver in System Preferences > Desktop & Screen Saver?
No. the screen saver was active but since I have the power setting set to "display sleep" never it should never activate the screen saver.
You are correct. The power settings are independent of the screen saver.
