If the iPhone is not lost, but the passcode is unavailable and that for whatever reason, then the data is gone.

Gone? Yes. The passcode is the decryption key to the data on the device.
If the phone is disabled you have already lost the data on it. To put it in Lost mode see→If your iPhone, iPad, or iPod touch is lost or stolen - Apple Support
If you mean the screen lock passcode, no, unless it has no passcode. In that specific case you can put the phone in Lost mode, which will let you create a passcode for it.
