How do I update a phone that has been given to me (it's been restarted so it's at the sign in page thingy) I can't restore my backup from my old phone because this new phone needs to be on the same update (which it's not)

With the gift phone first do set it up as a new iPhone. That will not erase your old data. Then update it to the new iOS and then restore the backup. You may have to erase the gift iphone before restoring. Follow this

However if you still have your old phone and a computer, PC or Mac, back up the old one to the computer and then do the Restore using the computer. That is the best method in my opinion and will not require the erase prior to restoring.

Do a minimal activation on the gift phone with as little setup as it allows you. Then update the gift phone to the new iOS and then restore the backup from the old one that you had saved.
