iPhone 12 Pro Max flickers and overheats

From day 1 my 12 pro max has had issues. First I noticed the apps flickering and soon after the phone itself gets VERY warm - not charging, simply idling. Background apps refreshing is minimal (turned most of them off). Even as I type this I feel the phone warming up. ??

Phones get warm with processing photos in background especially if you have iCloud photos turned on (that process will not be visible) but get it looked at while it is still under warranty.

Flickering is not good or normal.
