Trash will not dump all contents MacBook Pro 15-inch Mid 2015, running Big Sur 11.4

I moved a copy of a previous time machine backup to the trash to recovery more space. When I tried to dump the trash, I get an error stating that some item is in use. I ahem checked the locked feature (it's not locked) and the shared feature (it's not shared) and the permissions feature (all read and write is set). The file will neither dump nor open. Now I cannot access the trash because it's "being emptied", eternally.

I'd rather not lose the data, but how do I regain control?
