It's the person named on the AppleCare agreement.

You can probably arrange for the device to be taken in, but the person whose name is on the agreement will need to present the device.

Who will Contact:

It is the person who currently owns this device, who will contact Apple. If that is not you, then have that person get this serviced for you, on their behalf.
