My iPad is now requesting activation lock, however the email address is not mine that the device is linked too. So not accepting my Apple ID or password to unlock. I purchased this from a store brand new

That iPad is not new. Someone else has set up an account on it. Return it for your money back. There is no way you can use it without the Apple ID and Password of the original owner.
