If I use apple care, will the new ipad be a refurbished one or a new one?

It will be a service replacement. Those can be new or refurbished, depending on availability of units at the time they process your replacement. You do not get to pick or choose what you get as all the AppleCare+ terms state is that you get a fully and properly functioning replacement.
