Apple watch unable to communicate while enabling unlock IPhone with Apple watch

Hello,

I bought iphone 13 Pro max and I have Apple watch series 6 with IOS 8. Untill iPhone 13 I could unlock my phone from Apple watch. Now i cannot enable unlock from Apple watch option from iPhone 13 Pro max. It says unable to communicate with apple watch. I did reset, restarted, erase data still not working. Please suggest it needs to be working with mask.

I seem to have found a "work around"/fix but it would require a lot of time.

back up iphone to icloud
erase everything except the cell plan
retore manually with the icloud backup
turn the feature on again from setting ->face id and passcodes -> unlock with apple watch
