How to stop auto brightness from maxing out the brightness when it is not enabled.

Are you suggesting that the iPad screen brightness changes regardless of your iPad settings?
To disable automatic changes to screen brightness and colour balance, ensure that TrueTone is disabled:
Settings > Display & Brightness > True Tone - set to OFF
A forced restart of your iPad might be helpful - as doing so will often resolve an isolated software issue:
