Special audio in not available on macbook pro m1

On all my new MBP M1s, Apple Music would not stream Spatial audio (latest OS v. as of 11/13) - the option is greyed out. However, if I download the song/album and play the downloaded file, the audio is spatial - no longer greyed out. Due to the large number of complaints across the web, I think this is an Apple M1 problem.
