I am trying to setup my iPhone 13 Pro Max from an iCloud backup but I cannot select the date of the back up...it does not allow me to even see the option of setup from a backup...do I need to wipe the phone and start over?

If you don't have your previous phone with you and can't use Quick Start, you may need to start the process of setting up your new phone again. See this link on how it should work --> https://support.apple.com/en-us/HT210218
