I don't know your Australian consumer law.. but I can't imagine they require Apple to replace something that you lost.
The consumer law more likely is regarding manufacturing defects and that that sort of thing.
Did you purchase Apple Care with Theft & Loss? That's the only way you'd get a replacement.

Hi Chris, no I didn't purchase apple care with theft or loss.
But see what I read on apple website:
. You are entitled to a repair, replacement, or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
yeah, I read that verbiage when I googled Australian consumer law.. I just don't think they are talking about physical loss (like monetary loss due to a failure or something). but I'm not a lawyer by any means ha ha.. just my take on it. Plus I think that'd be crazy if a company is on the hook because a consumer lost something. Just doesn't work logically in my head.
In any case, you're probably best off contacting Apple if you think it should be covered.
