Can I get a refund on a phone from Apple if bought in three store as they refuse on a unused phone that was an unwanted gift

If it was purchased directly from Apple, you can return it to Apple for a refund. If you purchased it from another retailer, that retailer's return policy applies.
If you bought it from three, then they are the ones who would have to refund your money. You didn't buy it from Apple, you bought it from three.
