Can a stolen Apple Watch be used?

My neighbor has my Apple Watch and they do not seem want to return it. The device has been on and off since it was lost and it keeps telling me on find my iPhone where it is but they won’t return it. Can they use it even if I had a password on? I marked it as lost and it keeps telling me it’s “pending” what does that mean? Can they reset it and use it ?
