Why does a Time machine back up fail if Photos is open?

A scheduled back up fails to complete giving the report that the back up can't be completed because a certain photo in the Photos App (a different one each time) can't be backed up. This only occurs if the Photos App is open, so I close Photos and tell Time Machine to Back Up Now and the back up completes no problem. So if Photos is open when when a scheduled backup runs it will fail. This only started happening since I installed Monterey.
