Where did you get this Apple Watch? If you did not purchase it from Apple, but rather from a third-party, then you may have been scammed. If they never disassociated it their account, then you're out of luck.

You don’t. Who ever the (actual) owner is has to do it. If that is you then use find my to unlock it

The person that you bought this watch from needs to follow all the steps in this link;

Remove the Activation Lock so that the buyer can use it.

If they can't or won't then get your money back or recycle the watch and mark it down as a bad experience.
