Old Mac version does not have migration assistant and I am unable to download anything so how can I transfer data to new Mac (which I have not purchased yet, trying yo figure this out first)

You can use the built in Migration Assistant, copy files to a external drive, sync with iCloud, or directly connect your old Mac using Target Disk Mode.
Migration Assistant is located in Applications - Utilities folder . I would be VERY VERY surprised to hear your old Mac is so old it does not have MA.
