The iPhone is signed into an iCloud account - presumably his - and requires a password to sign out so that you can use it.
He should have followed the steps described in the paragraph Remove your personal information from your old device in the support document What to do before you sell, give away or trade in your iPhone, iPad or iPod touch.
Then it would be ready for you to enter your Apple ID credentials and use it as your phone.
