How do i see my photos that were on my old device on my new device without having access to my old phone

If you synced with iCloud, your photos are at iCloud.com/photos and available on your new device if you enable iCloud photos (Settings > Photos).
If you did not sync with iCloud, your device backup that you made of your old phone -- before getting the new one -- will have the photos. Set up your new device using that backup.
If none of the above apply, you will be unable to get the photos as you no longer have the old phone.
