To remove the activation lock you can either remove it with the correct Apple id and password

Or if you are unable to do so, and you have proof of purchase, you can apply for Apple to remove the activation lock

If you do not know the person who holds the lock Apple cannot help you find them. In that case return the iPhone and get your money back.

You will need the Apple ID and Password of the original user who set up the phone. Without this info, youwill never get pat Activation Lock which is a theft prevention feature.
