Hello I recently bought new phone and immediately upon setting it up someone took control of my ID they also set up 2 factor authentication now I can not get access or even change password etc . What can I do

How can I regain access to my Apple account if someone has changed the password and even the Apple ID itself?

Any photos would still be on the device unless removed from iCloud (assuming you sync with iCloud). But, if you reset the device, anything on it will be lost. You'll need to recover from your backup(s).
