Unfortunately there is no way.
The seller needs to remove the iCloud lock (activation lock) beforehand in order to be able to be set up as new again.
If you bought it from eBay or Amazon, I would try to send it back because the iPhone is basically bricked and totally useless for you thus there is no workaround the activation lock.
