I am getting the new iPhone 13 and i have over a thousand photos and videos not uploaded to iCloud. When I swap phones will those photos and videos be deleted/will only the photos on my icloud be transferred?

Transferring with Photos being of High Concern:
iCloud is cloud storage --it will not be affected. All that would be affected is downloaded photos. So, upload all of those to iCloud, and the transfer would be same. Use QuickStart to perform the transfer, and all downloaded photos would transfer, if enough storage is provided on the new phone: Use Quick Start to Transfer Data to a New iPhone or iPad - Apple Support
