I have restarted both devices and still have the same error
To update to WatchOS9 you require a phone that's running ios16 which is an iphone 8 or higher.

And a series 4 watch is good for WatchOS9.
Thanks, that is what I was guessing. I am ordering a IPhone 14 Pro and I hope my watch isn't to old to take any updates as well :)
