Is Apple selling blacklisted Iphones?

I exchanged my iPhone at an Apple Store. The phone had front and back damaged glass. I was told I had to pay $99 to have the phone replaced. I was able to download my icloud data, and make a call in store. However, when I left to the parking lot I was unable to complete a call. I returned to the store explained the situation and they had me make a call. It went through. I checked to verify wifi calling was off and it was off. I left and again in the parking lot the phone failed to work. I went back to the store and was told it was a carrier issue. I asked for my receipt which was sent to me via email and another was printed at the store. I walked across the sidewalk to my carrier and was told the phone was blacklisted prior to my purchase. I returned to the Apple store and explained the situation. They said because they don't maintain the blacklist it is a working phone and they aren't responsible. I asked to talk to the store manager but was told they were not available and to call customer support. I asked what phone I could use since they gave me a non-working phone. (My previous phone only had front and back damage. I just wanted it repaired.) The Apple employees told me to use a pay phone or my house. I refused and was finally allowed to call customer care utilizing a phone in the store. Once I was able speak with a representative I was transferred to another representative who told me the phone worked fine, it was a carrier issue. I said that they sold it to me blacklisted but again was told the phone works fine. I requested an upgrade but was told I had to wait until iPhone 14 came out. So I bought a different phone to wait until the 14 came out... but we are back at the phone that apple sold me as blacklisted can't be upgraded. I'm confused how a phone sold by Apple that was blacklisted before I received the phone is my problem? I'm considering hiring an attorney and and requesting arbitration. Also I intend on contacting the California Attorney General to have them look into the matter. I'm pretty sure this is fraud. If the phone was blacklisted when I received it wouldn't that mean they sold a lost or stolen device? Should I just take this to the FCC since it is a communication device?

Follow up - called AT&T (my service provider) they maintain it's Apple's responsibility to fix the phone. AT&T did however refer it to their fraud department and call Apple with me to explain. Apple told me and the AT&T support rep that it is impossible for any of their phones to go out with a blacklist on an IMEI. AT&T customer service explained the issue (that the IMEI number was in fact 'blacklisted' prior to receiving it.) I've retained a lawyer for a legal remedy (Demand letter then I assume arbitration) because pinballing back and forth is no longer an option. I'll post another follow up on the results.

It’s normal that you wouldn’t receive a box for a replacement device (outside of a new one in box being given within the return/exchange period). So that part isn’t odd. The issue is…it’s not working if it doesn’t have service when you leave the store which makes me think they are basing “working” on it being connected via Wi-Fi and not actually connected to wireless service. You need to escalate this. With a manager at that store and if necessary with Apple corporate. And with AT&T. If you can’t get anywhere on either side you may have to check and see if you have any legal remedies you can use.

This just happened to me! I haven’t had a working phone for 6 days until yesterday! I got the IPhone 14 max pro through Verizon and it was delivered 10/25. A week later I’m like whoa I see a scratch. I go to Verizon they’re like this is an Apple product they can fix it. I go to Apple and I pay $29 bucks for the repair since I have Apple Card plus. They do the repair and I pick it up and ask 3x is it activated. They assure it is and I just need my laptop for my code for my iCloud. My phone doesn’t work it says SOS in the corner. I use my bf phone to call Verizon and they’re like this esim isn’t working. 1- Apple hit keep esim instead of forget esim when they took my phone to repair it. 2- after 4 days of non stop Apple saying not their problem, I call Apple headquarters. They tell me they’ll replace my phone etc. every time I went to get my phone they said it’s not the phone and the store refused to give me a new one for five days. Finally Saturday, after speaking with tier 2 verizon support, they’re like this esim is on the non-pay list. This essentially means stolen, he’s like yeah this is a bad phone and then verizon tier 2 began questioning me about being a fraud! Finally I get my replacement on Sunday evening from Apple and Monday morning I go to verizon and they have my phone working in two minutes. It was the phone the entire time because it was blacklisted! The senior advisor offered me a free accessory! Nope, I told her I have to lawyer up and start the legal battle for fraud and negligence and emotional distress. I couldn’t work for 2.5 days because I get security codes sent to my phone. Oh also, quick trick- google model numbers! I googled the model number after they repaired my phone and it came in with nothing found and in Chinese but no phone comes up like it says nothing found then just Chinese below where jtbsays. I googled the one Verizon had in store and came up US IPhone 14 max pro purple!

This was an actual Apple store? Why couldn’t they replace the phone again if the issue is continuing and no one can get it to work properly? Never heard of this situation but Apple is correct. The carrier listed it as black listed. Apple wouldn’t get in trouble for selling a blacklisted device in the sense that someone who stole it would…likely owed the carrier money on it, got a replacement from Apple and jumped to another carrier since the replacement was unlocked and failed to finish paying the carrier installment owed versus stealing the phone from an individual and taking it to Apple (they would have needed to have the passcode to unlock it as well as the Apple ID, etc when they took it to Apple. If you have the receipt take it back to Apple and request an exchange or a refund due to the issue. Unless your receipt or anything you signed in store stated you were accepting the device as-is and isn’t eligible for a refund

Yes! This was an Apple store. Though something that wasn't normal to me is that they wouldn't give me a box. They said since it was refurbished I wouldn't receive a box. That's exactly what I have done multiple times at multiple stores. The store I bought it from says you can't exchange a working phone. I even asked for my phone back but they said they couldn't do that either....even though it was the same day. I don't think this is an Apple company problem other than the multiple times I've been stonewalled. Im afraid the person who gave me the phone is doing something that isn't trackable by Apple and is passing out blacklisted phones for his own benefit somehow. This has been ongoing since June. AT&T says.there is nothing they can do... I agree the blacklist isn't apples problem but if that's true then why can't I return the phone to them? They say they can't accept it.
