Microphone black circle not an orange dot

Black microphone circle on iPhone 13 will not go away. You can open it and it says “listen” or “pause” and and then pinch it closed. Every question I have asked refers to an orange dot. If you click on circle it opens with microphone open or pause but the black circle remains on the screen and I have to keep moving it. Help
