You must contact the person currently signed in, too sign out of it. Nothing can be done on your end. Have the person perform as instructed here, including the backup: What to do Before you Sell, Give Away, or Trade In your iPhone or iPad - Apple Support. The seller should have known better.

You cannot. Activation Lock is intended as a theft deterrent, and deliberately not easy to bypass. We can’t help, and Apple won’t; you here lack the paperwork necessary for help from Apple. Recycle it.
