iOS 16.2 installation on iPhone 14 Pro Max

Hello, I have had the new iPhone 14 Pro Max since Dec 20, but I still cannot install the iOS 16.2 update. The message I got is "You can install this update when your iPhone is finished restoring from the iCloud backup". I have been using the phone since day one and there is no message I can locate indicating the incomplete restore. Any suggestion?

Please keep the iPhone connected to the internet and let it finish the backup. It is recommended that you have a backup before you start the iOS update.

I have connected my phone with the charger right next to the WiFi many times. It still hasn't updated the software. There is no indication that the backup hasn't finished. Is there a way I can find out?
